Privacy Policy

At Brooks Tropicals, Inc.., (“Brooks,” “us,” “we,” or “our”), we recognize that many visitors to our web site (“Site”) are concerned about the information they provide to us and how we treat that information. We have adopted this privacy policy (“Privacy Policy”) to explain what information may be collected on our Site and how such information may be used and/or shared with others. This Privacy Policy applies solely to information collected through our Site and not through any other sources. This Privacy Policy is subject to the terms and conditions posted on our Site (“Terms and Conditions”).  Please review this Privacy Policy each time you visit our Site to ensure that you have read and agree with the current policy, as it may be amended without notice.

Personal Information:  We do not automatically collect personal information (names, addresses, phone numbers, social security numbers or e-mail addresses) from our Site visitors.  However, visitors to our Site may choose to volunteer this type of information when they register as members, make purchases and submit online job applications.  While we may use this personal visitor information as a basis for enhancing our Site, we never sell or transfer the information to third parties.

You should also remember that when you voluntarily disclose personal information on a bulletin board or in a chat room, that information could be collected and used by other web surfers, resulting in unsolicited messages from other parties.  In addition, our Site may contain links to other sites.  While we make every reasonable effort to link to sites that share our respect for privacy, we are not responsible for the content or privacy practices of other sites.

Non-Personal Information:    Our server(s) automatically collect(s) non-personal information, such as the type of operating system or web browser used by our visitors. We may use this information to provide an enhanced online experience and to track the aggregate number of visitors to our Site.  In accordance with our Privacy Policy, we do not sell or transfer any non-personal visitor information to third parties.  Rather, we may retain it and may use it as a basis for improving our Site.

Cookies:   In addition to the non-personally identifiable information described above, we may also send you “cookies.” Cookies are small text files from a website that are stored on your hard drive. These small text files make using a website more convenient by saving your passwords and preferences for you. Cookies themselves do not contain any personally

identifiable information. We may analyze the information derived from these cookies and match such information with data provided by you or another party. We may provide our analysis and certain non-personally identifiable information to potential partners, advertisers (who may use this information to provide advertisements tailored to your interests) or other third parties, but we will not disclose any personally identifiable information, except as provided in this Privacy Policy.

You have the option of deciding whether or not to accept a cookie by resetting your browser to notify you whenever a cookie is being sent to your hard drive. You may also delete a cookie manually from your hard drive. Please note, however, that some parts of our Site may not function properly or may be considerably slower if you refuse to accept a cookie or choose to disable your cookies settings.

Additional Disclosure: We reserve the right to disclose any personally identifiable or non-personally identifiable information if we are required to do so by law or if we reasonably believe that such action is necessary in order to: (i) fulfill a government request; (ii) conform with the requirements of the law or to comply with legal process served on us; (iii) protect or defend our legal or property rights, our Site or its users; or (iv) in an emergency to protect the health and safety of our Site’s users or the general public.

Children Under 13: When activities on our Site are designed specifically for children, they will be collected in clearly designated sections of the Site (“Children’s Section”). We understand the concerns of parents regarding privacy, especially when it comes to protecting information collected from children, and we strongly encourage parents to supervise and participate in their children’s online activities and consider using parental control tools available through online services and software. These tools help parents maintain an Internet environment appropriate for children.

In addition, to protecting the interest of children which visit our Site, it is our policy not to solicit or post any information from visitors under the age of 13 without the consent of a parent or legal guardian.  In the event that a child under 13 years of age submits information to our Site and we become aware of such submittal, we will delete the information. Further, we do not actively seek demographic or preference information from children, we will not send direct e-mail offers to users that indicate that they are less than 13 years of age, and, most importantly, we do not knowingly or intentionally disclose personal information regarding children to third parties.

Other Sites:  Our Site may contain links to other websites that we do not control or maintain. We are not responsible for the privacy practices employed by these other websites. We encourage you to note when you leave our Site and to read the privacy statements of such other websites before submitting any personally identifiable information.

Keeping Your Information Secure:  We have reasonable and appropriate electronic and physical security measures in place to protect against the loss, misuse and alteration of the information under our control. Please be advised, however, that while we strive to protect your personally identifiable information and privacy, we cannot guarantee or warrant the security of any information you disclose or transmit to us and cannot be responsible for the theft, destruction, or inadvertent disclosure of your personally identifiable information.

Sale of Company:  If another entity acquires us or all or substantially all of our assets, personally identifiable information, non-personally identifiable information, and any other information that we have collected about the users of our Site may be transferred to such entity as one of the transferred assets. Also, if any bankruptcy or reorganization proceeding is brought by or against us, all such information may be considered an asset of ours and as such may be sold or transferred to third parties.
